These Terms of Service ("Terms") govern your access to and use of AdsInvestigator, operated by BnB Digital Marketing ("we," "our," or "us"), available at ads.bnbdigitalmarketing.com. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Description of Service

AdsInvestigator is a Google Ads audit and analysis platform that helps advertisers identify wasted spend, tracking issues, and optimisation opportunities. The platform connects to Google Ads accounts via the Google Ads API (read-only) and analyses uploaded CSV/Excel exports to generate audit reports, recommendations, and AI-powered executive summaries.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organisation you represent. By using the platform, you represent that you meet these requirements.

3. Account Registration

You must sign in to use the platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Google Ads API Usage

When you connect your Google Ads account, you authorise AdsInvestigator to access your Google Ads data via the Google Ads API in read-only mode. You represent and warrant that:

• You have the legal right and authority to grant access to the Google Ads account(s) you connect
• You will not use the platform to access accounts you are not authorised to manage
• You understand that AdsInvestigator does not modify, create, or delete any Google Ads data

Your use of Google Ads data through our platform is also subject to Google's API Terms of Service and Google's Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Upload data you do not have the right to use or share
• Attempt to reverse-engineer, decompile, or extract the source code of the platform
• Use automated means to scrape, crawl, or extract data from the platform
• Interfere with or disrupt the integrity or performance of the platform
• Attempt to gain unauthorised access to any part of the platform or its related systems
• Resell, sublicense, or commercially exploit the platform without our written consent

6. Audit Reports and Recommendations

Audit reports, recommendations, and AI-generated summaries provided by AdsInvestigator are for informational purposes only. They do not constitute professional financial, legal, or advertising advice. You are solely responsible for any decisions you make based on the platform's output. We make no guarantee that implementing our recommendations will achieve specific results.

7. Intellectual Property

The platform, including its design, software, audit engine logic, and content, is owned by BnB Digital Marketing and protected by intellectual property laws. You retain ownership of your data (Google Ads data, uploaded files, business context). You grant us a limited licence to process your data solely for the purpose of providing the service.

8. Third-Party Services

The platform integrates with third-party services including Google Ads API, OpenAI, and Anthropic (for optional AI features). Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the availability, accuracy, or practices of these third-party services.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BNB DIGITAL MARKETING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We reserve the right to suspend or terminate your access to the platform at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
